*b1cdbd2cSJim Jagielski and/or in combination with its Contributor Version (or portions
*b1cdbd2cSJim Jagielski of such combination), to make, use, sell, offer for sale, have
*b1cdbd2cSJim Jagielski made, and/or otherwise dispose of: 1) Modifications made by that

*b1cdbd2cSJim Jagielski Modifications made by that Contributor with its Contributor
*b1cdbd2cSJim Jagielski Version (or portions of such combination).
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (c) the licenses granted in Sections 2.2(a) and 2.2(b) are
*b1cdbd2cSJim Jagielski effective on the date Contributor first makes Commercial Use of
*b1cdbd2cSJim Jagielski the Covered Code.

*b1cdbd2cSJim Jagielski that Contributor.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski3. Distribution Obligations.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.1. Application of License.
*b1cdbd2cSJim Jagielski The Modifications which You create or to which You contribute are
*b1cdbd2cSJim Jagielski governed by the terms of this License, including without limitation
*b1cdbd2cSJim Jagielski Section 2.2. The Source Code version of Covered Code may be
*b1cdbd2cSJim Jagielski distributed only under the terms of this License or a future version
*b1cdbd2cSJim Jagielski of this License released under Section 6.1, and You must include a
*b1cdbd2cSJim Jagielski copy of this License with every copy of the Source Code You
*b1cdbd2cSJim Jagielski distribute. You may not offer or impose any terms on any Source Code
*b1cdbd2cSJim Jagielski version that alters or restricts the applicable version of this
*b1cdbd2cSJim Jagielski License or the recipients' rights hereunder. However, You may include
*b1cdbd2cSJim Jagielski an additional document offering the additional rights described in
*b1cdbd2cSJim Jagielski Section 3.5.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.2. Availability of Source Code.
*b1cdbd2cSJim Jagielski Any Modification which You create or to which You contribute must be
*b1cdbd2cSJim Jagielski made available in Source Code form under the terms of this License
*b1cdbd2cSJim Jagielski either on the same media as an Executable version or via an accepted
*b1cdbd2cSJim Jagielski Electronic Distribution Mechanism to anyone to whom you made an
*b1cdbd2cSJim Jagielski Executable version available; and if made available via Electronic
*b1cdbd2cSJim Jagielski Distribution Mechanism, must remain available for at least twelve (12)
*b1cdbd2cSJim Jagielski months after the date it initially became available, or at least six
*b1cdbd2cSJim Jagielski (6) months after a subsequent version of that particular Modification
*b1cdbd2cSJim Jagielski has been made available to such recipients. You are responsible for
*b1cdbd2cSJim Jagielski ensuring that the Source Code version remains available even if the
*b1cdbd2cSJim Jagielski Electronic Distribution Mechanism is maintained by a third party.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.3. Description of Modifications.
*b1cdbd2cSJim Jagielski You must cause all Covered Code to which You contribute to contain a
*b1cdbd2cSJim Jagielski file documenting the changes You made to create that Covered Code and
*b1cdbd2cSJim Jagielski the date of any change. You must include a prominent statement that
*b1cdbd2cSJim Jagielski the Modification is derived, directly or indirectly, from Original
*b1cdbd2cSJim Jagielski Code provided by the Initial Developer and including the name of the
*b1cdbd2cSJim Jagielski Initial Developer in (a) the Source Code, and (b) in any notice in an
*b1cdbd2cSJim Jagielski Executable version or related documentation in which You describe the
*b1cdbd2cSJim Jagielski origin or ownership of the Covered Code.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.4. Intellectual Property Matters
*b1cdbd2cSJim Jagielski (a) Third Party Claims.
*b1cdbd2cSJim Jagielski If Contributor has knowledge that a license under a third party's
*b1cdbd2cSJim Jagielski intellectual property rights is required to exercise the rights
*b1cdbd2cSJim Jagielski granted by such Contributor under Sections 2.1 or 2.2,
*b1cdbd2cSJim Jagielski Contributor must include a text file with the Source Code
*b1cdbd2cSJim Jagielski distribution titled "LEGAL" which describes the claim and the
*b1cdbd2cSJim Jagielski party making the claim in sufficient detail that a recipient will
*b1cdbd2cSJim Jagielski know whom to contact. If Contributor obtains such knowledge after
*b1cdbd2cSJim Jagielski the Modification is made available as described in Section 3.2,
*b1cdbd2cSJim Jagielski Contributor shall promptly modify the LEGAL file in all copies
*b1cdbd2cSJim Jagielski Contributor makes available thereafter and shall take other steps
*b1cdbd2cSJim Jagielski (such as notifying appropriate mailing lists or newsgroups)
*b1cdbd2cSJim Jagielski reasonably calculated to inform those who received the Covered
*b1cdbd2cSJim Jagielski Code that new knowledge has been obtained.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (b) Contributor APIs.
*b1cdbd2cSJim Jagielski If Contributor's Modifications include an application programming
*b1cdbd2cSJim Jagielski interface and Contributor has knowledge of patent licenses which
*b1cdbd2cSJim Jagielski are reasonably necessary to implement that API, Contributor must
*b1cdbd2cSJim Jagielski also include this information in the LEGAL file.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (c) Representations.
*b1cdbd2cSJim Jagielski Contributor represents that, except as disclosed pursuant to
*b1cdbd2cSJim Jagielski Section 3.4(a) above, Contributor believes that Contributor's
*b1cdbd2cSJim Jagielski Modifications are Contributor's original creation(s) and/or
*b1cdbd2cSJim Jagielski Contributor has sufficient rights to grant the rights conveyed by
*b1cdbd2cSJim Jagielski this License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.5. Required Notices.
*b1cdbd2cSJim Jagielski You must duplicate the notice in Exhibit A in each file of the Source
*b1cdbd2cSJim Jagielski Code. If it is not possible to put such notice in a particular Source
*b1cdbd2cSJim Jagielski Code file due to its structure, then You must include such notice in a
*b1cdbd2cSJim Jagielski location (such as a relevant directory) where a user would be likely
*b1cdbd2cSJim Jagielski to look for such a notice. If You created one or more Modification(s)
*b1cdbd2cSJim Jagielski You may add your name as a Contributor to the notice described in
*b1cdbd2cSJim Jagielski Exhibit A. You must also duplicate this License in any documentation
*b1cdbd2cSJim Jagielski for the Source Code where You describe recipients' rights or ownership
*b1cdbd2cSJim Jagielski rights relating to Covered Code. You may choose to offer, and to
*b1cdbd2cSJim Jagielski charge a fee for, warranty, support, indemnity or liability
*b1cdbd2cSJim Jagielski obligations to one or more recipients of Covered Code. However, You
*b1cdbd2cSJim Jagielski may do so only on Your own behalf, and not on behalf of the Initial
*b1cdbd2cSJim Jagielski Developer or any Contributor. You must make it absolutely clear than
*b1cdbd2cSJim Jagielski any such warranty, support, indemnity or liability obligation is
*b1cdbd2cSJim Jagielski offered by You alone, and You hereby agree to indemnify the Initial
*b1cdbd2cSJim Jagielski Developer and every Contributor for any liability incurred by the
*b1cdbd2cSJim Jagielski Initial Developer or such Contributor as a result of warranty,
*b1cdbd2cSJim Jagielski support, indemnity or liability terms You offer.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.6. Distribution of Executable Versions.
*b1cdbd2cSJim Jagielski You may distribute Covered Code in Executable form only if the
*b1cdbd2cSJim Jagielski requirements of Section 3.1-3.5 have been met for that Covered Code,
*b1cdbd2cSJim Jagielski and if You include a notice stating that the Source Code version of
*b1cdbd2cSJim Jagielski the Covered Code is available under the terms of this License,
*b1cdbd2cSJim Jagielski including a description of how and where You have fulfilled the
*b1cdbd2cSJim Jagielski obligations of Section 3.2. The notice must be conspicuously included
*b1cdbd2cSJim Jagielski in any notice in an Executable version, related documentation or
*b1cdbd2cSJim Jagielski collateral in which You describe recipients' rights relating to the
*b1cdbd2cSJim Jagielski Covered Code. You may distribute the Executable version of Covered
*b1cdbd2cSJim Jagielski Code or ownership rights under a license of Your choice, which may
*b1cdbd2cSJim Jagielski contain terms different from this License, provided that You are in
*b1cdbd2cSJim Jagielski compliance with the terms of this License and that the license for the
*b1cdbd2cSJim Jagielski Executable version does not attempt to limit or alter the recipient's
*b1cdbd2cSJim Jagielski rights in the Source Code version from the rights set forth in this
*b1cdbd2cSJim Jagielski License. If You distribute the Executable version under a different
*b1cdbd2cSJim Jagielski license You must make it absolutely clear that any terms which differ
*b1cdbd2cSJim Jagielski from this License are offered by You alone, not by the Initial
*b1cdbd2cSJim Jagielski Developer or any Contributor. You hereby agree to indemnify the
*b1cdbd2cSJim Jagielski Initial Developer and every Contributor for any liability incurred by
*b1cdbd2cSJim Jagielski the Initial Developer or such Contributor as a result of any such
*b1cdbd2cSJim Jagielski terms You offer.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.7. Larger Works.
*b1cdbd2cSJim Jagielski You may create a Larger Work by combining Covered Code with other code
*b1cdbd2cSJim Jagielski not governed by the terms of this License and distribute the Larger
*b1cdbd2cSJim Jagielski Work as a single product. In such a case, You must make sure the
*b1cdbd2cSJim Jagielski requirements of this License are fulfilled for the Covered Code.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski4. Inability to Comply Due to Statute or Regulation.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski If it is impossible for You to comply with any of the terms of this
*b1cdbd2cSJim Jagielski License with respect to some or all of the Covered Code due to
*b1cdbd2cSJim Jagielski statute, judicial order, or regulation then You must: (a) comply with
*b1cdbd2cSJim Jagielski the terms of this License to the maximum extent possible; and (b)
*b1cdbd2cSJim Jagielski describe the limitations and the code they affect. Such description
*b1cdbd2cSJim Jagielski must be included in the LEGAL file described in Section 3.4 and must
*b1cdbd2cSJim Jagielski be included with all distributions of the Source Code. Except to the
*b1cdbd2cSJim Jagielski extent prohibited by statute or regulation, such description must be
*b1cdbd2cSJim Jagielski sufficiently detailed for a recipient of ordinary skill to be able to
*b1cdbd2cSJim Jagielski understand it.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski5. Application of this License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski This License applies to code to which the Initial Developer has
*b1cdbd2cSJim Jagielski attached the notice in Exhibit A and to related Covered Code.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski6. Versions of the License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 6.1. New Versions.
*b1cdbd2cSJim Jagielski Netscape Communications Corporation ("Netscape") may publish revised
*b1cdbd2cSJim Jagielski and/or new versions of the License from time to time. Each version
*b1cdbd2cSJim Jagielski will be given a distinguishing version number.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 6.2. Effect of New Versions.
*b1cdbd2cSJim Jagielski Once Covered Code has been published under a particular version of the
*b1cdbd2cSJim Jagielski License, You may always continue to use it under the terms of that
*b1cdbd2cSJim Jagielski version. You may also choose to use such Covered Code under the terms
*b1cdbd2cSJim Jagielski of any subsequent version of the License published by Netscape. No one
*b1cdbd2cSJim Jagielski other than Netscape has the right to modify the terms applicable to
*b1cdbd2cSJim Jagielski Covered Code created under this License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 6.3. Derivative Works.
*b1cdbd2cSJim Jagielski If You create or use a modified version of this License (which you may
*b1cdbd2cSJim Jagielski only do in order to apply it to code which is not already Covered Code
*b1cdbd2cSJim Jagielski governed by this License), You must (a) rename Your license so that
*b1cdbd2cSJim Jagielski the phrases "Mozilla", "MOZILLAPL", "MOZPL", "Netscape",
*b1cdbd2cSJim Jagielski "MPL", "NPL" or any confusingly similar phrase do not appear in your
*b1cdbd2cSJim Jagielski license (except to note that your license differs from this License)
*b1cdbd2cSJim Jagielski and (b) otherwise make it clear that Your version of the license
*b1cdbd2cSJim Jagielski contains terms which differ from the Mozilla Public License and
*b1cdbd2cSJim Jagielski Netscape Public License. (Filling in the name of the Initial
*b1cdbd2cSJim Jagielski Developer, Original Code or Contributor in the notice described in
*b1cdbd2cSJim Jagielski Exhibit A shall not of themselves be deemed to be modifications of
*b1cdbd2cSJim Jagielski this License.)
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski7. DISCLAIMER OF WARRANTY.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski COVERED CODE IS PROVIDED UNDER THIS LICENSE ON AN "AS IS" BASIS,
*b1cdbd2cSJim Jagielski WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING,
*b1cdbd2cSJim Jagielski WITHOUT LIMITATION, WARRANTIES THAT THE COVERED CODE IS FREE OF
*b1cdbd2cSJim Jagielski DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING.
*b1cdbd2cSJim Jagielski THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE COVERED CODE
*b1cdbd2cSJim Jagielski IS WITH YOU. SHOULD ANY COVERED CODE PROVE DEFECTIVE IN ANY RESPECT,
*b1cdbd2cSJim Jagielski YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE
*b1cdbd2cSJim Jagielski COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER
*b1cdbd2cSJim Jagielski OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF
*b1cdbd2cSJim Jagielski ANY COVERED CODE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski8. TERMINATION.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 8.1. This License and the rights granted hereunder will terminate
*b1cdbd2cSJim Jagielski automatically if You fail to comply with terms herein and fail to cure
*b1cdbd2cSJim Jagielski such breach within 30 days of becoming aware of the breach. All
*b1cdbd2cSJim Jagielski sublicenses to the Covered Code which are properly granted shall
*b1cdbd2cSJim Jagielski survive any termination of this License. Provisions which, by their
*b1cdbd2cSJim Jagielski nature, must remain in effect beyond the termination of this License
*b1cdbd2cSJim Jagielski shall survive.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 8.2. If You initiate litigation by asserting a patent infringement
*b1cdbd2cSJim Jagielski claim (excluding declatory judgment actions) against Initial Developer
*b1cdbd2cSJim Jagielski or a Contributor (the Initial Developer or Contributor against whom
*b1cdbd2cSJim Jagielski You file such action is referred to as "Participant") alleging that:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (a) such Participant's Contributor Version directly or indirectly
*b1cdbd2cSJim Jagielski infringes any patent, then any and all rights granted by such
*b1cdbd2cSJim Jagielski Participant to You under Sections 2.1 and/or 2.2 of this License
*b1cdbd2cSJim Jagielski shall, upon 60 days notice from Participant terminate prospectively,
*b1cdbd2cSJim Jagielski unless if within 60 days after receipt of notice You either: (i)
*b1cdbd2cSJim Jagielski agree in writing to pay Participant a mutually agreeable reasonable
*b1cdbd2cSJim Jagielski royalty for Your past and future use of Modifications made by such
*b1cdbd2cSJim Jagielski Participant, or (ii) withdraw Your litigation claim with respect to
*b1cdbd2cSJim Jagielski the Contributor Version against such Participant. If within 60 days
*b1cdbd2cSJim Jagielski of notice, a reasonable royalty and payment arrangement are not
*b1cdbd2cSJim Jagielski mutually agreed upon in writing by the parties or the litigation claim
*b1cdbd2cSJim Jagielski is not withdrawn, the rights granted by Participant to You under
*b1cdbd2cSJim Jagielski Sections 2.1 and/or 2.2 automatically terminate at the expiration of
*b1cdbd2cSJim Jagielski the 60 day notice period specified above.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (b) any software, hardware, or device, other than such Participant's
*b1cdbd2cSJim Jagielski Contributor Version, directly or indirectly infringes any patent, then
*b1cdbd2cSJim Jagielski any rights granted to You by such Participant under Sections 2.1(b)
*b1cdbd2cSJim Jagielski and 2.2(b) are revoked effective as of the date You first made, used,
*b1cdbd2cSJim Jagielski sold, distributed, or had made, Modifications made by that
*b1cdbd2cSJim Jagielski Participant.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 8.3. If You assert a patent infringement claim against Participant
*b1cdbd2cSJim Jagielski alleging that such Participant's Contributor Version directly or
*b1cdbd2cSJim Jagielski indirectly infringes any patent where such claim is resolved (such as
*b1cdbd2cSJim Jagielski by license or settlement) prior to the initiation of patent
*b1cdbd2cSJim Jagielski infringement litigation, then the reasonable value of the licenses
*b1cdbd2cSJim Jagielski granted by such Participant under Sections 2.1 or 2.2 shall be taken
*b1cdbd2cSJim Jagielski into account in determining the amount or value of any payment or
*b1cdbd2cSJim Jagielski license.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 8.4. In the event of termination under Sections 8.1 or 8.2 above,
*b1cdbd2cSJim Jagielski all end user license agreements (excluding distributors and resellers)
*b1cdbd2cSJim Jagielski which have been validly granted by You or any distributor hereunder
*b1cdbd2cSJim Jagielski prior to termination shall survive termination.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski9. LIMITATION OF LIABILITY.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
*b1cdbd2cSJim Jagielski (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL YOU, THE INITIAL
*b1cdbd2cSJim Jagielski DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF COVERED CODE,
*b1cdbd2cSJim Jagielski OR ANY SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY PERSON FOR
*b1cdbd2cSJim Jagielski ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
*b1cdbd2cSJim Jagielski CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL,
*b1cdbd2cSJim Jagielski WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
*b1cdbd2cSJim Jagielski COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN
*b1cdbd2cSJim Jagielski INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF
*b1cdbd2cSJim Jagielski LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY
*b1cdbd2cSJim Jagielski RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW
*b1cdbd2cSJim Jagielski PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE
*b1cdbd2cSJim Jagielski EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
*b1cdbd2cSJim Jagielski THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski10. U.S. GOVERNMENT END USERS.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski The Covered Code is a "commercial item," as that term is defined in
*b1cdbd2cSJim Jagielski 48 C.F.R. 2.101 (Oct. 1995), consisting of "commercial computer
*b1cdbd2cSJim Jagielski software" and "commercial computer software documentation," as such
*b1cdbd2cSJim Jagielski terms are used in 48 C.F.R. 12.212 (Sept. 1995). Consistent with 48
*b1cdbd2cSJim Jagielski C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995),
*b1cdbd2cSJim Jagielski all U.S. Government End Users acquire Covered Code with only those
*b1cdbd2cSJim Jagielski rights set forth herein.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski11. MISCELLANEOUS.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski This License represents the complete agreement concerning subject
*b1cdbd2cSJim Jagielski matter hereof. If any provision of this License is held to be
*b1cdbd2cSJim Jagielski unenforceable, such provision shall be reformed only to the extent
*b1cdbd2cSJim Jagielski necessary to make it enforceable. This License shall be governed by
*b1cdbd2cSJim Jagielski California law provisions (except to the extent applicable law, if
*b1cdbd2cSJim Jagielski any, provides otherwise), excluding its conflict-of-law provisions.
*b1cdbd2cSJim Jagielski With respect to disputes in which at least one party is a citizen of,
*b1cdbd2cSJim Jagielski or an entity chartered or registered to do business in the United
*b1cdbd2cSJim Jagielski States of America, any litigation relating to this License shall be
*b1cdbd2cSJim Jagielski subject to the jurisdiction of the Federal Courts of the Northern
*b1cdbd2cSJim Jagielski District of California, with venue lying in Santa Clara County,
*b1cdbd2cSJim Jagielski California, with the losing party responsible for costs, including
*b1cdbd2cSJim Jagielski without limitation, court costs and reasonable attorneys' fees and
*b1cdbd2cSJim Jagielski expenses. The application of the United Nations Convention on
*b1cdbd2cSJim Jagielski Contracts for the International Sale of Goods is expressly excluded.
*b1cdbd2cSJim Jagielski Any law or regulation which provides that the language of a contract
*b1cdbd2cSJim Jagielski shall be construed against the drafter shall not apply to this
*b1cdbd2cSJim Jagielski License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski12. RESPONSIBILITY FOR CLAIMS.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski As between Initial Developer and the Contributors, each party is
*b1cdbd2cSJim Jagielski responsible for claims and damages arising, directly or indirectly,
*b1cdbd2cSJim Jagielski out of its utilization of rights under this License and You agree to
*b1cdbd2cSJim Jagielski work with Initial Developer and Contributors to distribute such
*b1cdbd2cSJim Jagielski responsibility on an equitable basis. Nothing herein is intended or
*b1cdbd2cSJim Jagielski shall be deemed to constitute any admission of liability.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski13. MULTIPLE-LICENSED CODE.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski Initial Developer may designate portions of the Covered Code as
*b1cdbd2cSJim Jagielski "Multiple-Licensed". "Multiple-Licensed" means that the Initial
*b1cdbd2cSJim Jagielski Developer permits you to utilize portions of the Covered Code under
*b1cdbd2cSJim Jagielski Your choice of the NPL or the alternative licenses, if any, specified
*b1cdbd2cSJim Jagielski by the Initial Developer in the file described in Exhibit A.

*b1cdbd2cSJim Jagielski Original Code, without such additional products becoming
*b1cdbd2cSJim Jagielski subject to the terms of this License, and may license such
*b1cdbd2cSJim Jagielski additional products on different terms from those contained
*b1cdbd2cSJim Jagielski in this License.
*b1cdbd2cSJim Jagielski

*b1cdbd2cSJim Jagielski Netscape may license the Source Code of Netscape's Branded
*b1cdbd2cSJim Jagielski Code, including Modifications incorporated therein, without
*b1cdbd2cSJim Jagielski such Netscape Branded Code becoming subject to the terms of
*b1cdbd2cSJim Jagielski this License, and may license such Netscape Branded Code on
*b1cdbd2cSJim Jagielski different terms from those contained in this License.

*b1cdbd2cSJim Jagielski Code governed by this License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 1.11. ``Source Code'' means the preferred form of the Covered Code for making
*b1cdbd2cSJim Jagielski modifications to it, including all modules it contains, plus any associated
*b1cdbd2cSJim Jagielski interface definition files, scripts used to control compilation and
*b1cdbd2cSJim Jagielski installation of an Executable, or a list of source code differential
*b1cdbd2cSJim Jagielski comparisons against either the Original Code or another well known,
*b1cdbd2cSJim Jagielski available Covered Code of the Contributor's choice. The Source Code can
*b1cdbd2cSJim Jagielski be in a compressed or archival form, provided the appropriate decompression
*b1cdbd2cSJim Jagielski or de-archiving software is widely available for no charge.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 1.12. ``You'' means an individual or a legal entity exercising rights under,
*b1cdbd2cSJim Jagielski and complying with all of the terms of, this License or a future version
*b1cdbd2cSJim Jagielski of this License issued under Section 6.1. For legal entities, ``You''
*b1cdbd2cSJim Jagielski includes any entity which controls, is controlled by, or is under common
*b1cdbd2cSJim Jagielski control with You. For purposes of this definition, ``control'' means
*b1cdbd2cSJim Jagielski (a) the power, direct or indirect, to cause the direction or management
*b1cdbd2cSJim Jagielski of such entity, whether by contract or otherwise, or (b) ownership of
*b1cdbd2cSJim Jagielski fifty percent (50%) or more of the outstanding shares or beneficial
*b1cdbd2cSJim Jagielski ownership of such entity.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski2. Source Code License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 2.1. The Initial Developer Grant.
*b1cdbd2cSJim Jagielski The Initial Developer hereby grants You a world-wide, royalty-free, non-exclusive
*b1cdbd2cSJim Jagielski license, subject to third party intellectual property claims:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (a) to use, reproduce, modify, display, perform, sublicense and distribute
*b1cdbd2cSJim Jagielski the Original Code (or portions thereof) with or without Modifications,
*b1cdbd2cSJim Jagielski or as part of a Larger Work; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (b) under patents now or hereafter owned or controlled by Initial Developer,
*b1cdbd2cSJim Jagielski to make, have made, use and sell (``Utilize'') the Original Code
*b1cdbd2cSJim Jagielski (or portions thereof), but solely to the extent that any such patent
*b1cdbd2cSJim Jagielski is reasonably necessary to enable You to Utilize the Original Code
*b1cdbd2cSJim Jagielski (or portions thereof) and not to any greater extent that may be necessary
*b1cdbd2cSJim Jagielski to Utilize further Modifications or combinations.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 2.2. Contributor Grant.
*b1cdbd2cSJim Jagielski Each Contributor hereby grants You a world-wide, royalty-free, non-exclusive
*b1cdbd2cSJim Jagielski license, subject to third party intellectual property claims:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (a) to use, reproduce, modify, display, perform, sublicense and distribute
*b1cdbd2cSJim Jagielski the Modifications created by such Contributor (or portions thereof)
*b1cdbd2cSJim Jagielski either on an unmodified basis, with other Modifications, as Covered
*b1cdbd2cSJim Jagielski Code or as part of a Larger Work; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (b) under patents now or hereafter owned or controlled by Contributor,
*b1cdbd2cSJim Jagielski to Utilize the Contributor Version (or portions thereof), but solely
*b1cdbd2cSJim Jagielski to the extent that any such patent is reasonably necessary to enable
*b1cdbd2cSJim Jagielski You to Utilize the Contributor Version (or portions thereof), and
*b1cdbd2cSJim Jagielski not to any greater extent that may be necessary to Utilize further
*b1cdbd2cSJim Jagielski Modifications or combinations.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski3. Distribution Obligations.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.1. Application of License.
*b1cdbd2cSJim Jagielski The Modifications which You create or to which You contribute are governed
*b1cdbd2cSJim Jagielski by the terms of this License, including without limitation Section 2.2.
*b1cdbd2cSJim Jagielski The Source Code version of Covered Code may be distributed only under the
*b1cdbd2cSJim Jagielski terms of this License or a future version of this License released under
*b1cdbd2cSJim Jagielski Section 6.1, and You must include a copy of this License with every copy
*b1cdbd2cSJim Jagielski of the Source Code You distribute. You may not offer or impose any terms
*b1cdbd2cSJim Jagielski on any Source Code version that alters or restricts the applicable version
*b1cdbd2cSJim Jagielski of this License or the recipients' rights hereunder. However, You may include
*b1cdbd2cSJim Jagielski an additional document offering the additional rights described in Section 3.5.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.2. Availability of Source Code.
*b1cdbd2cSJim Jagielski Any Modification which You create or to which You contribute must be made
*b1cdbd2cSJim Jagielski available in Source Code form under the terms of this License either on
*b1cdbd2cSJim Jagielski the same media as an Executable version or via an accepted Electronic
*b1cdbd2cSJim Jagielski Distribution Mechanism to anyone to whom you made an Executable version
*b1cdbd2cSJim Jagielski available; and if made available via Electronic Distribution Mechanism,
*b1cdbd2cSJim Jagielski must remain available for at least twelve (12) months after the date it
*b1cdbd2cSJim Jagielski initially became available, or at least six (6) months after a subsequent
*b1cdbd2cSJim Jagielski version of that particular Modification has been made available to such
*b1cdbd2cSJim Jagielski recipients. You are responsible for ensuring that the Source Code version
*b1cdbd2cSJim Jagielski remains available even if the Electronic Distribution Mechanism is maintained
*b1cdbd2cSJim Jagielski by a third party.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.3. Description of Modifications.
*b1cdbd2cSJim Jagielski You must cause all Covered Code to which you contribute to contain a file
*b1cdbd2cSJim Jagielski documenting the changes You made to create that Covered Code and the date of
*b1cdbd2cSJim Jagielski any change. You must include a prominent statement that the Modification is
*b1cdbd2cSJim Jagielski derived, directly or indirectly, from Original Code provided by the Initial
*b1cdbd2cSJim Jagielski Developer and including the name of the Initial Developer in (a) the Source
*b1cdbd2cSJim Jagielski Code, and (b) in any notice in an Executable version or related documentation
*b1cdbd2cSJim Jagielski in which You describe the origin or ownership of the Covered Code.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.4. Intellectual Property Matters
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (a) Third Party Claims.
*b1cdbd2cSJim Jagielski If You have knowledge that a party claims an intellectual property right
*b1cdbd2cSJim Jagielski in particular functionality or code (or its utilization under this License),
*b1cdbd2cSJim Jagielski you must include a text file with the source code distribution titled
*b1cdbd2cSJim Jagielski ``LEGAL'' which describes the claim and the party making the claim in
*b1cdbd2cSJim Jagielski sufficient detail that a recipient will know whom to contact. If you
*b1cdbd2cSJim Jagielski obtain such knowledge after You make Your Modification available as
*b1cdbd2cSJim Jagielski described in Section 3.2, You shall promptly modify the LEGAL file in
*b1cdbd2cSJim Jagielski all copies You make available thereafter and shall take other steps
*b1cdbd2cSJim Jagielski (such as notifying appropriate mailing lists or newsgroups) reasonably
*b1cdbd2cSJim Jagielski calculated to inform those who received the Covered Code that new
*b1cdbd2cSJim Jagielski knowledge has been obtained.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski (b) Contributor APIs.
*b1cdbd2cSJim Jagielski If Your Modification is an application programming interface and You
*b1cdbd2cSJim Jagielski own or control patents which are reasonably necessary to implement that
*b1cdbd2cSJim Jagielski API, you must also include this information in the LEGAL file.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.5. Required Notices.
*b1cdbd2cSJim Jagielski You must duplicate the notice in Exhibit A in each file of the Source Code,
*b1cdbd2cSJim Jagielski and this License in any documentation for the Source Code, where You describe
*b1cdbd2cSJim Jagielski recipients' rights relating to Covered Code. If You created one or more
*b1cdbd2cSJim Jagielski Modification(s), You may add your name as a Contributor to the notice described
*b1cdbd2cSJim Jagielski in Exhibit A. If it is not possible to put such notice in a particular Source
*b1cdbd2cSJim Jagielski Code file due to its structure, then you must include such notice in a location
*b1cdbd2cSJim Jagielski (such as a relevant directory file) where a user would be likely to look for
*b1cdbd2cSJim Jagielski such a notice. You may choose to offer, and to charge a fee for, warranty,
*b1cdbd2cSJim Jagielski support, indemnity or liability obligations to one or more recipients of
*b1cdbd2cSJim Jagielski Covered Code. However, You may do so only on Your own behalf, and not on
*b1cdbd2cSJim Jagielski behalf of the Initial Developer or any Contributor. You must make it absolutely
*b1cdbd2cSJim Jagielski clear than any such warranty, support, indemnity or liability obligation is
*b1cdbd2cSJim Jagielski offered by You alone, and You hereby agree to indemnify the Initial Developer
*b1cdbd2cSJim Jagielski and every Contributor for any liability incurred by the Initial Developer or
*b1cdbd2cSJim Jagielski such Contributor as a result of warranty, support, indemnity or liability terms
*b1cdbd2cSJim Jagielski You offer.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.6. Distribution of Executable Versions.
*b1cdbd2cSJim Jagielski You may distribute Covered Code in Executable form only if the requirements
*b1cdbd2cSJim Jagielski of Section 3.1-3.5 have been met for that Covered Code, and if You include
*b1cdbd2cSJim Jagielski a notice stating that the Source Code version of the Covered Code is available
*b1cdbd2cSJim Jagielski under the terms of this License, including a description of how and where You
*b1cdbd2cSJim Jagielski have fulfilled the obligations of Section 3.2. The notice must be conspicuously
*b1cdbd2cSJim Jagielski included in any notice in an Executable version, related documentation or
*b1cdbd2cSJim Jagielski collateral in which You describe recipients' rights relating to the Covered
*b1cdbd2cSJim Jagielski Code. You may distribute the Executable version of Covered Code under a license
*b1cdbd2cSJim Jagielski of Your choice, which may contain terms different from this License, provided
*b1cdbd2cSJim Jagielski that You are in compliance with the terms of this License and that the license
*b1cdbd2cSJim Jagielski for the Executable version does not attempt to limit or alter the recipient's
*b1cdbd2cSJim Jagielski rights in the Source Code version from the rights set forth in this License.
*b1cdbd2cSJim Jagielski If You distribute the Executable version under a different license You must
*b1cdbd2cSJim Jagielski make it absolutely clear that any terms which differ from this License are
*b1cdbd2cSJim Jagielski offered by You alone, not by the Initial Developer or any Contributor. You
*b1cdbd2cSJim Jagielski hereby agree to indemnify the Initial Developer and every Contributor for
*b1cdbd2cSJim Jagielski any liability incurred by the Initial Developer or such Contributor as a
*b1cdbd2cSJim Jagielski result of any such terms You offer.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 3.7. Larger Works.
*b1cdbd2cSJim Jagielski You may create a Larger Work by combining Covered Code with other code not
*b1cdbd2cSJim Jagielski governed by the terms of this License and distribute the Larger Work as a
*b1cdbd2cSJim Jagielski single product. In such a case, You must make sure the requirements of this
*b1cdbd2cSJim Jagielski License are fulfilled for the Covered Code.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski4. Inability to Comply Due to Statute or Regulation.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski If it is impossible for You to comply with any of the terms of this License
*b1cdbd2cSJim Jagielski with respect to some or all of the Covered Code due to statute or regulation
*b1cdbd2cSJim Jagielski then You must: (a) comply with the terms of this License to the maximum extent
*b1cdbd2cSJim Jagielski possible; and (b) describe the limitations and the code they affect. Such
*b1cdbd2cSJim Jagielski description must be included in the LEGAL file described in Section 3.4 and
*b1cdbd2cSJim Jagielski must be included with all distributions of the Source Code. Except to the
*b1cdbd2cSJim Jagielski extent prohibited by statute or regulation, such description must be sufficiently
*b1cdbd2cSJim Jagielski detailed for a recipient of ordinary skill to be able to understand it.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski5. Application of this License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski This License applies to code to which the Initial Developer has attached the
*b1cdbd2cSJim Jagielski notice in Exhibit A, and to related Covered Code.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski6. Versions of the License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 6.1. New Versions.
*b1cdbd2cSJim Jagielski Netscape Communications Corporation (``Netscape'') may publish revised and/or
*b1cdbd2cSJim Jagielski new versions of the License from time to time. Each version will be given a
*b1cdbd2cSJim Jagielski distinguishing version number.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 6.2. Effect of New Versions.
*b1cdbd2cSJim Jagielski Once Covered Code has been published under a particular version of the License,
*b1cdbd2cSJim Jagielski You may always continue to use it under the terms of that version. You may also
*b1cdbd2cSJim Jagielski choose to use such Covered Code under the terms of any subsequent version of the
*b1cdbd2cSJim Jagielski License published by Netscape. No one other than Netscape has the right to
*b1cdbd2cSJim Jagielski modify the terms applicable to Covered Code created under this License.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski 6.3. Derivative Works.
*b1cdbd2cSJim Jagielski If you create or use a modified version of this License (which you may only do
*b1cdbd2cSJim Jagielski in order to apply it to code which is not already Covered Code governed by this
*b1cdbd2cSJim Jagielski License), you must (a) rename Your license so that the phrases ``Mozilla'',
*b1cdbd2cSJim Jagielski ``MOZILLAPL'', ``MOZPL'', ``Netscape'', ``NPL'' or any confusingly similar
*b1cdbd2cSJim Jagielski phrase do not appear anywhere in your license and (b) otherwise make it clear
*b1cdbd2cSJim Jagielski that your version of the license contains terms which differ from the Mozilla
*b1cdbd2cSJim Jagielski Public License and Netscape Public License. (Filling in the name of the Initial
*b1cdbd2cSJim Jagielski Developer, Original Code or Contributor in the notice described in Exhibit A
*b1cdbd2cSJim Jagielski shall not of themselves be deemed to be modifications of this License.)
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski7. DISCLAIMER OF WARRANTY.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski COVERED CODE IS PROVIDED UNDER THIS LICENSE ON AN ``AS IS'' BASIS, WITHOUT
*b1cdbd2cSJim Jagielski WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION,
*b1cdbd2cSJim Jagielski WARRANTIES THAT THE COVERED CODE IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A
*b1cdbd2cSJim Jagielski PARTICULAR PURPOSE OR NON-INFRINGING. THE ENTIRE RISK AS TO THE QUALITY AND
*b1cdbd2cSJim Jagielski PERFORMANCE OF THE COVERED CODE IS WITH YOU. SHOULD ANY COVERED CODE PROVE
*b1cdbd2cSJim Jagielski DEFECTIVE IN ANY RESPECT, YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR)
*b1cdbd2cSJim Jagielski ASSUME THE COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER
*b1cdbd2cSJim Jagielski OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF ANY COVERED
*b1cdbd2cSJim Jagielski CODE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski8. TERMINATION.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski This License and the rights granted hereunder will terminate automatically
*b1cdbd2cSJim Jagielski if You fail to comply with terms herein and fail to cure such breach within
*b1cdbd2cSJim Jagielski 30 days of becoming aware of the breach. All sublicenses to the Covered
*b1cdbd2cSJim Jagielski Code which are properly granted shall survive any termination of this
*b1cdbd2cSJim Jagielski License. Provisions which, by their nature, must remain in effect beyond
*b1cdbd2cSJim Jagielski the termination of this License shall survive.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski9. LIMITATION OF LIABILITY.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT (INCLUDING
*b1cdbd2cSJim Jagielski NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL THE INITIAL DEVELOPER, ANY OTHER
*b1cdbd2cSJim Jagielski CONTRIBUTOR, OR ANY DISTRIBUTOR OF COVERED CODE, OR ANY SUPPLIER OF ANY OF
*b1cdbd2cSJim Jagielski SUCH PARTIES, BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL,
*b1cdbd2cSJim Jagielski INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT
*b1cdbd2cSJim Jagielski LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE
*b1cdbd2cSJim Jagielski OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN
*b1cdbd2cSJim Jagielski IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
*b1cdbd2cSJim Jagielski THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR
*b1cdbd2cSJim Jagielski PERSONAL INJURY RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE
*b1cdbd2cSJim Jagielski LAW PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
*b1cdbd2cSJim Jagielski OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THAT EXCLUSION AND
*b1cdbd2cSJim Jagielski LIMITATION MAY NOT APPLY TO YOU.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski10. U.S. GOVERNMENT END USERS.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski The Covered Code is a ``commercial item,'' as that term is defined in
*b1cdbd2cSJim Jagielski 48 C.F.R. 2.101 (Oct. 1995), consisting of ``commercial computer software''
*b1cdbd2cSJim Jagielski and ``commercial computer software documentation,'' as such terms are used
*b1cdbd2cSJim Jagielski in 48 C.F.R. 12.212 (Sept. 1995). Consistent with 48 C.F.R. 12.212 and
*b1cdbd2cSJim Jagielski 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995), all U.S. Government
*b1cdbd2cSJim Jagielski End Users acquire Covered Code with only those rights set forth herein.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski11. MISCELLANEOUS.
*b1cdbd2cSJim Jagielski

*b1cdbd2cSJim Jagielski it enforceable. This License shall be governed by California law provisions
*b1cdbd2cSJim Jagielski (except to the extent applicable law, if any, provides otherwise), excluding

*b1cdbd2cSJim Jagielski all disputes relating to this License (excepting any dispute relating to
*b1cdbd2cSJim Jagielski intellectual property rights) shall be subject to final and binding arbitration,
*b1cdbd2cSJim Jagielski with the losing party paying all costs of arbitration; (b) any arbitration
*b1cdbd2cSJim Jagielski relating to this Agreement shall be held in Santa Clara County, California,
*b1cdbd2cSJim Jagielski under the auspices of JAMS/EndDispute; and (c) any litigation relating to

*b1cdbd2cSJim Jagielski1. DEFINITIONS
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski"Contribution" means:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskia) in the case of the initial Contributor, the initial code and documentation
*b1cdbd2cSJim Jagielskidistributed under this Agreement, and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskib) in the case of each subsequent Contributor:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskii) changes to the Program, and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskiii) additions to the Program;
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskiwhere such changes and/or additions to the Program originate from and are
*b1cdbd2cSJim Jagielskidistributed by that particular Contributor. A Contribution 'originates' from a
*b1cdbd2cSJim JagielskiContributor if it was added to the Program by such Contributor itself or anyone
*b1cdbd2cSJim Jagielskiacting on such Contributor's behalf. Contributions do not include additions to
*b1cdbd2cSJim Jagielskithe Program which: (i) are separate modules of software distributed in
*b1cdbd2cSJim Jagielskiconjunction with the Program under their own license agreement, and (ii) are not
*b1cdbd2cSJim Jagielskiderivative works of the Program.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski"Contributor" means any person or entity that distributes the Program.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski"Licensed Patents " mean patent claims licensable by a Contributor which are
*b1cdbd2cSJim Jagielskinecessarily infringed by the use or sale of its Contribution alone or when
*b1cdbd2cSJim Jagielskicombined with the Program.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski"Program" means the Contributions distributed in accordance with this Agreement.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski"Recipient" means anyone who receives the Program under this Agreement,
*b1cdbd2cSJim Jagielskiincluding all Contributors.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski2. GRANT OF RIGHTS
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskia) Subject to the terms of this Agreement, each Contributor hereby grants
*b1cdbd2cSJim JagielskiRecipient a non-exclusive, worldwide, royalty-free copyright license to
*b1cdbd2cSJim Jagielskireproduce, prepare derivative works of, publicly display, publicly perform,
*b1cdbd2cSJim Jagielskidistribute and sublicense the Contribution of such Contributor, if any, and such
*b1cdbd2cSJim Jagielskiderivative works, in source code and object code form.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskib) Subject to the terms of this Agreement, each Contributor hereby grants
*b1cdbd2cSJim JagielskiRecipient a non-exclusive, worldwide, royalty-free patent license under Licensed
*b1cdbd2cSJim JagielskiPatents to make, use, sell, offer to sell, import and otherwise transfer the
*b1cdbd2cSJim JagielskiContribution of such Contributor, if any, in source code and object code form.
*b1cdbd2cSJim JagielskiThis patent license shall apply to the combination of the Contribution and the
*b1cdbd2cSJim JagielskiProgram if, at the time the Contribution is added by the Contributor, such
*b1cdbd2cSJim Jagielskiaddition of the Contribution causes such combination to be covered by the
*b1cdbd2cSJim JagielskiLicensed Patents. The patent license shall not apply to any other combinations
*b1cdbd2cSJim Jagielskiwhich include the Contribution. No hardware per se is licensed hereunder.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskic) Recipient understands that although each Contributor grants the licenses to
*b1cdbd2cSJim Jagielskiits Contributions set forth herein, no assurances are provided by any
*b1cdbd2cSJim JagielskiContributor that the Program does not infringe the patent or other intellectual
*b1cdbd2cSJim Jagielskiproperty rights of any other entity. Each Contributor disclaims any liability to
*b1cdbd2cSJim JagielskiRecipient for claims brought by any other entity based on infringement of
*b1cdbd2cSJim Jagielskiintellectual property rights or otherwise. As a condition to exercising the
*b1cdbd2cSJim Jagielskirights and licenses granted hereunder, each Recipient hereby assumes sole
*b1cdbd2cSJim Jagielskiresponsibility to secure any other intellectual property rights needed, if any.
*b1cdbd2cSJim JagielskiFor example, if a third party patent license is required to allow Recipient to
*b1cdbd2cSJim Jagielskidistribute the Program, it is Recipient's responsibility to acquire that license
*b1cdbd2cSJim Jagielskibefore distributing the Program.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskid) Each Contributor represents that to its knowledge it has sufficient copyright
*b1cdbd2cSJim Jagielskirights in its Contribution, if any, to grant the copyright license set forth in
*b1cdbd2cSJim Jagielskithis Agreement.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski3. REQUIREMENTS
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiA Contributor may choose to distribute the Program in object code form under its
*b1cdbd2cSJim Jagielskiown license agreement, provided that:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskia) it complies with the terms and conditions of this Agreement; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskib) its license agreement:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskii) effectively disclaims on behalf of all Contributors all warranties and
*b1cdbd2cSJim Jagielskiconditions, express and implied, including warranties or conditions of title and
*b1cdbd2cSJim Jagielskinon-infringement, and implied warranties or conditions of merchantability and
*b1cdbd2cSJim Jagielskifitness for a particular purpose;
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskiii) effectively excludes on behalf of all Contributors all liability for
*b1cdbd2cSJim Jagielskidamages, including direct, indirect, special, incidental and consequential
*b1cdbd2cSJim Jagielskidamages, such as lost profits;
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskiiii) states that any provisions which differ from this Agreement are offered by
*b1cdbd2cSJim Jagielskithat Contributor alone and not by any other party; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskiiv) states that source code for the Program is available from such Contributor,
*b1cdbd2cSJim Jagielskiand informs licensees how to obtain it in a reasonable manner on or through a
*b1cdbd2cSJim Jagielskimedium customarily used for software exchange.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiWhen the Program is made available in source code form:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskia) it must be made available under this Agreement; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielskib) a copy of this Agreement must be included with each copy of the Program.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiContributors may not remove or alter any copyright notices contained within the
*b1cdbd2cSJim JagielskiProgram.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiEach Contributor must identify itself as the originator of its Contribution, if
*b1cdbd2cSJim Jagielskiany, in a manner that reasonably allows subsequent Recipients to identify the
*b1cdbd2cSJim Jagielskioriginator of the Contribution.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski4. COMMERCIAL DISTRIBUTION
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiCommercial distributors of software may accept certain responsibilities with
*b1cdbd2cSJim Jagielskirespect to end users, business partners and the like. While this license is
*b1cdbd2cSJim Jagielskiintended to facilitate the commercial use of the Program, the Contributor who
*b1cdbd2cSJim Jagielskiincludes the Program in a commercial product offering should do so in a manner
*b1cdbd2cSJim Jagielskiwhich does not create potential liability for other Contributors. Therefore, if
*b1cdbd2cSJim Jagielskia Contributor includes the Program in a commercial product offering, such
*b1cdbd2cSJim JagielskiContributor ("Commercial Contributor") hereby agrees to defend and indemnify
*b1cdbd2cSJim Jagielskievery other Contributor ("Indemnified Contributor") against any losses, damages
*b1cdbd2cSJim Jagielskiand costs (collectively "Losses") arising from claims, lawsuits and other legal
*b1cdbd2cSJim Jagielskiactions brought by a third party against the Indemnified Contributor to the
*b1cdbd2cSJim Jagielskiextent caused by the acts or omissions of such Commercial Contributor in
*b1cdbd2cSJim Jagielskiconnection with its distribution of the Program in a commercial product
*b1cdbd2cSJim Jagielskioffering. The obligations in this section do not apply to any claims or Losses
*b1cdbd2cSJim Jagielskirelating to any actual or alleged intellectual property infringement. In order
*b1cdbd2cSJim Jagielskito qualify, an Indemnified Contributor must: a) promptly notify the Commercial
*b1cdbd2cSJim JagielskiContributor in writing of such claim, and b) allow the Commercial Contributor to
*b1cdbd2cSJim Jagielskicontrol, and cooperate with the Commercial Contributor in, the defense and any
*b1cdbd2cSJim Jagielskirelated settlement negotiations. The Indemnified Contributor may participate in
*b1cdbd2cSJim Jagielskiany such claim at its own expense.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiFor example, a Contributor might include the Program in a commercial product
*b1cdbd2cSJim Jagielskioffering, Product X. That Contributor is then a Commercial Contributor. If that
*b1cdbd2cSJim JagielskiCommercial Contributor then makes performance claims, or offers warranties
*b1cdbd2cSJim Jagielskirelated to Product X, those performance claims and warranties are such
*b1cdbd2cSJim JagielskiCommercial Contributor's responsibility alone. Under this section, the
*b1cdbd2cSJim JagielskiCommercial Contributor would have to defend claims against the other
*b1cdbd2cSJim JagielskiContributors related to those performance claims and warranties, and if a court
*b1cdbd2cSJim Jagielskirequires any other Contributor to pay any damages as a result, the Commercial
*b1cdbd2cSJim JagielskiContributor must pay those damages.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski5. NO WARRANTY
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiEXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE PROGRAM IS PROVIDED ON AN
*b1cdbd2cSJim Jagielski"AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR
*b1cdbd2cSJim JagielskiIMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE,
*b1cdbd2cSJim JagielskiNON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Each
*b1cdbd2cSJim JagielskiRecipient is solely responsible for determining the appropriateness of using and
*b1cdbd2cSJim Jagielskidistributing the Program and assumes all risks associated with its exercise of
*b1cdbd2cSJim Jagielskirights under this Agreement, including but not limited to the risks and costs of
*b1cdbd2cSJim Jagielskiprogram errors, compliance with applicable laws, damage to or loss of data,
*b1cdbd2cSJim Jagielskiprograms or equipment, and unavailability or interruption of operations.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski6. DISCLAIMER OF LIABILITY
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiEXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER RECIPIENT NOR ANY
*b1cdbd2cSJim JagielskiCONTRIBUTORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL,
*b1cdbd2cSJim JagielskiSPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST
*b1cdbd2cSJim JagielskiPROFITS), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT,
*b1cdbd2cSJim JagielskiSTRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY
*b1cdbd2cSJim JagielskiOUT OF THE USE OR DISTRIBUTION OF THE PROGRAM OR THE EXERCISE OF ANY RIGHTS
*b1cdbd2cSJim JagielskiGRANTED HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski7. GENERAL
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiIf any provision of this Agreement is invalid or unenforceable under applicable
*b1cdbd2cSJim Jagielskilaw, it shall not affect the validity or enforceability of the remainder of the
*b1cdbd2cSJim Jagielskiterms of this Agreement, and without further action by the parties hereto, such
*b1cdbd2cSJim Jagielskiprovision shall be reformed to the minimum extent necessary to make such
*b1cdbd2cSJim Jagielskiprovision valid and enforceable.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiIf Recipient institutes patent litigation against a Contributor with respect to
*b1cdbd2cSJim Jagielskia patent applicable to software (including a cross-claim or counterclaim in a
*b1cdbd2cSJim Jagielskilawsuit), then any patent licenses granted by that Contributor to such Recipient
*b1cdbd2cSJim Jagielskiunder this Agreement shall terminate as of the date such litigation is filed. In
*b1cdbd2cSJim Jagielskiaddition, If Recipient institutes patent litigation against any entity
*b1cdbd2cSJim Jagielski(including a cross-claim or counterclaim in a lawsuit) alleging that the Program
*b1cdbd2cSJim Jagielskiitself (excluding combinations of the Program with other software or hardware)
*b1cdbd2cSJim Jagielskiinfringes such Recipient's patent(s), then such Recipient's rights granted under
*b1cdbd2cSJim JagielskiSection 2(b) shall terminate as of the date such litigation is filed.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiAll Recipient's rights under this Agreement shall terminate if it fails to
*b1cdbd2cSJim Jagielskicomply with any of the material terms or conditions of this Agreement and does
*b1cdbd2cSJim Jagielskinot cure such failure in a reasonable period of time after becoming aware of
*b1cdbd2cSJim Jagielskisuch noncompliance. If all Recipient's rights under this Agreement terminate,

*b1cdbd2cSJim Jagielski1. DEFINITIONS
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski"Contribution" means:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski a) in the case of the initial Contributor, the initial code and
*b1cdbd2cSJim Jagielskidocumentation distributed under this Agreement, and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski b) in the case of each subsequent Contributor:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski i) changes to the Program, and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski    ii) additions to the Program;
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski where such changes and/or additions to the Program originate from and are
*b1cdbd2cSJim Jagielskidistributed by that particular Contributor.
*b1cdbd2cSJim Jagielski a) Subject to the terms of this Agreement, each Contributor hereby grants
*b1cdbd2cSJim Jagielski b) Subject to the terms of this Agreement, each Contributor hereby grants
*b1cdbd2cSJim Jagielski c) Recipient understands that although each Contributor grants the licenses
*b1cdbd2cSJim Jagielskito its Contributions set forth herein, no assurances are provided by any
*b1cdbd2cSJim JagielskiContributor that the Program does not infringe the patent or other intellectual
*b1cdbd2cSJim Jagielski d) Each Contributor represents that to its knowledge it has sufficient
*b1cdbd2cSJim Jagielskicopyright rights in its Contribution, if any, to grant the copyright license set
*b1cdbd2cSJim Jagielskiforth in this Agreement.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski3. REQUIREMENTS
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiA Contributor may choose to distribute the Program in object code form under its
*b1cdbd2cSJim Jagielskiown license agreement, provided that:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski a) it complies with the terms and conditions of this Agreement; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski b) its license agreement:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski i) effectively disclaims on behalf of all Contributors all warranties and
*b1cdbd2cSJim Jagielskiconditions, express and implied, including warranties or conditions of title and
*b1cdbd2cSJim Jagielskinon-infringement, and implied warranties or conditions of merchantability and
*b1cdbd2cSJim Jagielskifitness for a particular purpose;
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski ii) effectively excludes on behalf of all Contributors all liability for
*b1cdbd2cSJim Jagielskidamages, including direct, indirect, special, incidental and consequential
*b1cdbd2cSJim Jagielskidamages, such as lost profits;
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski iii) states that any provisions which differ from this Agreement are offered
*b1cdbd2cSJim Jagielskiby that Contributor alone and not by any other party; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski iv) states that source code for the Program is available from such
*b1cdbd2cSJim JagielskiContributor, and informs licensees how to obtain it in a reasonable manner on or
*b1cdbd2cSJim Jagielskithrough a medium customarily used for software exchange.
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim JagielskiWhen the Program is made available in source code form:
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski a) it must be made available under this Agreement; and
*b1cdbd2cSJim Jagielski
*b1cdbd2cSJim Jagielski b) a copy of this Agreement must be included with each copy of the Program.
*b1cdbd2cSJim Jagielski
If all Recipient's rights under this Agreement terminate,
*b1cdbd2cSJim JagielskiRecipient agrees to cease use and distribution of the Program as soon as
*b1cdbd2cSJim Jagielskireasonably practicable. However, Recipient's obligations under this Agreement
*b1cdbd2cSJim Jagielskiand any licenses granted by Recipient relating to the Program shall continue and
*b1cdbd2cSJim Jagielskisurvive.

*b1cdbd2cSJim Jagielskiis published, Contributor may elect to distribute the Program (including its
*b1cdbd2cSJim JagielskiContributions) under the new version. Except as expressly stated in Sections
*b1cdbd2cSJim Jagielski2(a) and 2(b) above, Recipient receives no rights or licenses to the
*b1cdbd2cSJim Jagielskiintellectual property of any Contributor under this Agreement, whether
